Spector drops lawsuit
19/12/2005 - 09:59:33
Music producer Phil Spector has abandoned a lawsuit against his former
attorney Robert Shapiro, who he claims cheated him.
Spector claims he gave Shapiro a $1 million (?817,000) retainer after he was
arrested for the murder of actress Lana Clarkson in February 2003 at his
California home.
But he alleged the lawyer did "very little legal work" and used his "legal
plight as an opportunity to unabashedly line their own pockets".
Spector - whose trial will begin in April 2006 - filed a dismissal without
prejudice at Los Angeles Superior Court on Thursday.
The move means he can file another suit in the future if he chooses.
Shapiro's lawyer says: "We're very happy because the case has been
completely dismissed and Bob Shapiro has been completely vindicated."

Spector sues agent for embezzlement
27/09/2005 - 09:10:41
Record producer Phil Spector, who is awaiting trial for murder, is suing his
financial agent Micheline Blaine, claiming she stole thousands of dollars
from his bank accounts.
Spector, 64, filed suit in Los Angeles Superior Court on Thursday, alleging
Blaine admitted to him that she had taken money from his accounts and had
spent it with her son.
The music mogul alleges Blaine took out a loan from his pension plan to use
in two companies, BT Productions and 3:15 Productions, which she co-owned
with a second defendant, Nori Takei.
Spector claims he never gave her authorisation to take out a loan and only
discovered Blaine's alleged dealings on Monday during a conversation with
his accountants.
The suit also states Blaine used cheques and a debit/cheque card from
Spector's accounts to withdraw money.
Spector has demanded repayment of the money and unspecified damages.
Spector, who has worked with top stars, including Ike and Tina Turner,
George Harrison and John Lennon, has pleaded not guilty to the fatal
shooting of actress Lana Clarkson in his Alhambra, California, mansion in
February 2003 and is on $1 (?831,700) bail as he awaits trial.

Los Angeles: Dealing the defence a potentially serious blow, a Los Angeles
judge has ruled that four women may testify that rock legend Phil Spector
threatened them with guns over the 15 years before he allegedly shot actress
Lana Clarkson in the face.
The music producer initially said the February 2003 shooting was an
accident, but he now contends Ms Clarkson killed herself. Prosecutors say
the testimony will show Spector had a habit of waving guns at women who
rejected him. The alleged incidents involving the four women seem similar to
the case at hand, Judge Larry Fidler said on Monday.
In each case, Spector had been drinking alcohol and was romantically
interested in the woman, but grew angry after the woman spurned him. Each
time, he then allegedly pointed a gun at the woman to prevent her from
walking out, according to a court document filed by the prosecution. The
incidents allegedly occurred in 1988, 1991, 1993 and 1995. Two of the four
women called the police at the time, but both declined to press charges.
Such evidence, Judge Fidler said, "can be used to show lack of accident or
mistake" in Spector's behaviour on the night of Ms Clarkson's death.
Prosecutors contend Spector shot Ms Clarkson - whom he had met at the House
of Blues club that night and had brought home - because she tried to leave.
Bruce Cutler, for the defence, disparaged the women as "sycophants and
parasites" who hung around Spector when he was powerful and associated with
him even after the incidents. The evidence would prejudice a jury, he said.
The Deputy District Attorney, Doug Sortino, argued that the witnesses were
important to show that Spector had a "common plan or scheme" involving women
and guns.
The law generally prohibits prosecutors from introducing evidence of prior
bad acts at trial to show that the defendant had a propensity for committing
a crime, legal experts say. But evidence can be allowed to show a pattern of
conduct.

Grisly Scene Described in Spector Case
By Anna Gorman
Times Staff Writer
December 10, 2003
Actress Lana Clarkson died of a single gunshot wound to the mouth at rock
producer Phil Spector's Alhambra mansion in February, according to search
warrants unsealed Tuesday in the rock music producer's murder case.
Her broken teeth lay scattered around the foyer and a nearby stairway, and
blood was smeared on the wood railing of the stairway and the back door
handle. Detectives also discovered blood on a man's coat in an upstairs
dressing room and found a blood-soaked cloth in a bathroom near the foyer,
the court papers said. Law enforcement sources said the blood belonged to
Clarkson.
The revelations came in search warrants, affidavits and other papers ordered
released by Los Angeles County Superior Court Judge Carlos Uranga at the
request of The Times.
Prosecutors charged Spector, 63, in November with murdering Clarkson, a
nightclub hostess and aspiring actress, on Feb. 3. He is free on $1-million
bail and faces a possible life sentence if convicted.
Spector's driver, Adriano Desouza, told investigators he had driven his boss
to four bars on the night of Clarkson's death. Court papers state that
Spector had drinks at all four. At the House of Blues, where he met
Clarkson, he ordered an $8.50 alcoholic drink and a $5 bottle of water, and
left a tip of $450.
About 3:30 a.m., Desouza dropped Spector and Clarkson off in front of the
12,000-square-foot home before driving around to the back, the court papers
said. About 10 minutes later, Spector came outside and got a brown leather
briefcase from the Mercedes limousine.
Just before 5 a.m., Desouza told police, he heard a single gunshot. Spector
came outside with a gun in his hand, the affidavits said, and told his
driver that he thought he had killed someone.
The smearing of Clarkson's blood around the house may indicate that Spector
tried to clean up after the shooting, law enforcement sources said Tuesday.
But Spector's attorney, Robert Shapiro, has said that evidence compiled by
his team of scientific experts showed that the shooting was not a homicide,
and that a jury would conclude that his client is not guilty.
In his only public statement since the killing, Spector told a magazine
interviewer that Clarkson, 40, had committed suicide.
A coroner's report on the shooting concluded that gunshot residue appeared
on both of Clarkson's hands. "Therefore the decedent may have discharged a
firearm or had . hands otherwise in an environment of gunshot residue,"
according to the report, portions of which were read to The Times on
Tuesday.
According to the coroner's report, the medical examiner based his conclusion
that the shooting had been a homicide on statements in law enforcement
reports that Spector had had the gun in his hand when it discharged, and
that the murder weapon had been taken from a holster in a drawer at the
house. In addition, there was no evidence that Clarkson had a history of
suicide attempts or that she had left a note, the report said.
Detectives searched Spector's home after Alhambra police responded to a 911
call from his driver and found Clarkson's body slumped on a chair in the
foyer.
"She had what appeared to be a single entry gunshot wound to the mouth,"
according to an affidavit signed by Sheriff's Det. Mark Lillienfeld.
She was wearing a black dress and black shoes, and a leopard-print purse
hung from her right shoulder. In the living room, candles burned on a
fireplace mantel and a brandy glass, a tequila bottle and a soft drink sat
on a coffee table, according to court documents.
Detectives also found a bloody, .38-caliber, six-shot revolver under
Clarkson's leg. There were five live cartridges in the cylinder and a spent
cartridge under the hammer. The gun was one of 10 firearms recovered from
the Alhambra mansion, according to the court papers.
Detectives seized several other items, including computers, a camcorder, gun
holsters and ammunition. They also recovered a lever for a deadbolt lock for
the back door and a wet hand towel from the sink top.
In addition to searching Spector's home, detectives searched three cars and
obtained phone and bank records.

LOS ANGELES - Record producer Phil Spector's $1 million bail was extended a
second time while the district attorney's office considers whether to charge
him in the shooting death of a woman at his home in February.
Spector, 62, who is free on bail, has denied he killed Lana Clarkson (news). He
suggested in an Esquire magazine interview that Clarkson, an actress and
hostess at the House of Blues, may have shot herself.
The decision to extend Spector's bail to Jan. 9 was made between lawyers and
the judge in Spector's case, Superior Court spokesman Allan Parachini said
Friday. He said he did not know when the decision was made or who had requested
the extension.
District attorney's spokeswoman Sandi Gibbons said she had "no personal
knowledge" of the second extension. Spector's lawyer, Robert Shapiro, declined
to comment when reached by telephone Friday evening.
In a report submitted Sept. 16, sheriff's detectives concluded Spector shot
Clarkson.
Spector, whose "wall of sound" recording technique transformed 1960s pop music,
was arrested Feb. 3 after the body of Clarkson, 40, was found in the foyer of
his Alhambra mansion.
He produced such hits as "Da Doo Ron Ron," "Then He Kissed Me," and "To Know
Him is to Love Him."
-
LOS ANGELES (Reuters) - Los Angeles sheriff's detectives have concluded that
legendary music producer Phil Spector shot B-movie actress Lana Clarkson at his
home in February and have turned the case over to prosecutors, a sheriff's
spokesman said on Friday.
"The charges we are looking at would be anything from second-degree murder to
manslaughter," Deputy Scott Butler said. "They are not saying it was an
accident. If it were deemed accidental, evidence would not have been gathered."
Prosecutors were reviewing the evidence against Spector and were expected to
announce a charging decision next week, Sandi Gibbons, a spokeswoman for the
Los Angeles County District Attorney's Office, said.
In June, Spector told Esquire magazine that Clarkson killed herself by putting
the gun in her mouth and pulling the trigger in the foyer of his Los
Angeles-area mansion on Feb. 3. Spector, 62, and the 40-year-old Clarkson had
just returned from a night of partying.
"She kissed the gun. I have no idea why -- (I) never knew her, I never even saw
her before that night ... I have no idea who she was, or what her agenda was,"
Spector told the magazine. "She killed herself. If they had a case, I'd be
sitting in jail right now."
Police found Clarkson dead in a pool of blood in the foyer of Spector's
castle-like mansion in the L.A. suburb of Alhambra just before dawn on Feb. 3.
Spector was arrested within hours of the Feb. 3 shooting on suspicion of murder
and released on $1 million bond. The Los Angeles County Coroner later revealed
that Clarkson had been shot once in the face.
The tall, blond Clarkson, who idolized Marilyn Monroe (news) and starred in
such films as "Amazon Women on the Moon" and "The Barbarian Queen" was working
at the House of Blues nightclub on the Sunset Strip on the night of her death.
Spector wrote and produced his first No. 1 hit, "To Know Him Is To Love Him" at
age 17 and went on to produce 17 top-10 U.S. hits in a decade, and helping the
Beatles put out their "Let It Be" album.

NY POST...PAGE 6
IT'S a good thing cursing out cops isn't against the law, or Phil Spector would
really be facing hard time. An L.A. judge unsealed trans of taped
statements Spector made to cops in Alhambra, Calif., the morning he allegedly
murdered B-movie queen Lana Clarkson two years ago. While berating the police,
the rock producer dropped the F-bomb 33 times. A typical excerpt: "You're gonna
pay for the [bleep]ing! I have been locked up for the bleep[ing] last 12
[bleep]ing hours. And you people come in my house and rummage through my
[bleep]ing house, and you tie me down like a [bleep]ing pig." His lawyer, Roger
Rosen, said Spector understandably flipped out after being roughed up by the
cops: "You can't look at this in a vacuum. What is a proper response under
those conditions? Frankly, I think they're lucky they got as little anger out
of him as they did." Alcohol might be an even more likely explanation for
Spector's rage. Witnesses have testified that Spector was so drunk that night,
he publicly urinated in a nightclub parking lot before being driven home.

LOS ANGELES - Rock music producer Phil Spector initially told police he
mistakenly shot actress Lana Clarkson, though he has since changed his story to
suggest she committed suicide, according to newly released grand jury
trans.
Alhambra Police Officer Beatrice Rodriguez testified that Spector told officers
at his home, "What's wrong with you guys? What are you doing? I didn't mean to
shoot her. It was an accident."
Spector, 64, who created rock 'n' roll's "wall of sound" recording technique,
is charged with murdering Clarkson at his Alhambra mansion in early 2003. He
has pleaded not guilty and is free on $1 million bail. He suggested in a 2003
interview with Esquire magazine that Clarkson, 40, may have shot herself.
The Los Angeles Times reported Friday on the contents of the five volumes of
grand jury trans, which include testimony from police, women who had been
previously threatened by Spector, and friends of Clarkson. The documents were
made available this week after media organizations including the Times and The
Associated Press won a legal battle to unseal them.
According to the trans cited by the Times, Spector's chauffeur, Adriano
De Souza, testified that after he heard a gunshot while waiting outside,
Spector emerged from his home holding a revolver and said, "I think I killed
somebody."
Three women also testified that Spector, in separate incidents, had acted
recklessly and threatened them with a gun. Prosecutor Doug Sortino told grand
jurors their testimony demonstrated that Spector was guilty of implied malice,
meaning he acted in such an "inherently dangerous" way that he could be
responsible for murder.
The most recent incident came at a 1999 holiday party at a Beverly Hills-area
home. Deborah Strand told the grand jury that she saw a man she later learned
was Spector flicking ash from his cigar on her boyfriend's dog after it jumped
on him.
When she told him, "You can leave," Spector turned around and pointed a gun at
her right cheek, she testified.
"He said, 'What are you going to say now?'" she told the grand jury. "He looked
at me, and I looked at his bodyguard (who) was standing by the entranceway and
I said, 'Get him out of here now.' ... That registered in his head, and he
immediately took the gun off of my face, put it away; and in a matter of
seconds they left without force. They just walked out, that was it."
A Superior Court judge said in November that Spector's lawyers failed to show
how releasing the grand jury trans would prevent a fair jury from being
chosen for trial. On Wednesday, an appellate court lifted an order staying
release of the documents.

Phil Spector charged with murder
Record producer Phil Spector was today charged with murder over the shooting
of a B-movie actress at his mansion last year.
Spector, 64, leaned on the arm of his lawyer as the charge of murdering
40-year-old Lana Clarkson was read out, but showed no emotion.
He was allowed to remain on $1m bail.
Spector spoke only briefly in the Los Angeles court, answering, "Yes, your
honour," to Judge David Lesley's questions.
The judge set December 16 as the earliest possible trial date.
Spector, creator of rock music's "Wall of Sound" recording technique in the
1960s, suggested in an interview with Esquire magazine that Clarkson shot
herself.
The judge agreed to keep the trial in Los Angeles rather than move it to
Pasadena, closer to Spector's home in Alhambra. Lawyers for both sides
expressed concern about the crush of reporters expected to attend, and
pointed out that the courtrooms in Los Angeles are bigger.
Clarkson starred in Roger Corman's cult film classic Barbarian Queen. She
was working as a hostess at the House of Blues on the Sunset Strip and went
home from there with Spector on the night she was killed.

LOS ANGELES (Reuters) - A lawyer for Phil Spector said on Wednesday he has been
asked to bring the rock producer to court next week and fears his client has
been indicted by a secret grand jury for the 2003 murder of a B-movie actress.
"Nobody said to me, 'Your client has been indicted,' but as a former deputy
district attorney and a lawyer for 34 years I can't imagine any other reason to
be there Monday morning with Phil," attorney Roger Rosen told Reuters.
Prosecutors declined to comment on the Spector case, which stems from the Feb.
3, 2003 shooting death of 40-year-old Lana Clarkson, star of such films as "The
Barbarian Queen" and "Amazon Women on the Moon," at his mansion near Los
Angeles.
Spector, best-known for his pioneering "Wall of Sound" recording technique and
his work with the Beatles, was charged in November of 2003 with Clarkson's
murder.
Defense attorneys had been preparing for a preliminary hearing in which
prosecutors would have had to show enough evidence against Spector to bind him
over for trial.
By taking the unusual step of obtaining an indictment, Rosen said, prosecutors
were able to skip that step. He said that was evidence that their case was
weak.
"Phil is very disappointed," Rosen said. "He believed that at the time of the
preliminary hearing we would have the opportunity to challenge the evidence. He
felt strongly that there was a very significant possibility that this case
would be thrown out at the prelim, so he's very disappointed that he's lost
that chance."
Clarkson, who met Spector while working at the "House of Blues" nightclub on
the Sunset Strip, was found dead in the foyer of his 33-room faux castle. An
autopsy report found that she had been killed by a single gunshot after the
weapon had been placed in her mouth.
Prosecutors say police found blood and gunshot residue on Spector, as well as
evidence that he had cleaned and moved the gun after the shooting. They say the
reclusive music producer has a history of pointing guns at women.
Spector claimed in an interview with Esquire magazine that the tall, blond
actress killed herself in a bizarre suicide that involved kissing the gun. His
attorneys say the autopsy report shows that the gunshot was self-inflicted.

ALHAMBRA, Calif. - Music producer Phil Spector and his new lawyer said Tuesday
they need more time to prepare for his murder case and won a delay in
scheduling the preliminary hearing.
Superior Court Judge Carlos Uranga, after meeting with lawyers, said the date
will be set Dec. 16.
Spector is charged with the shooting of actress Lana Clarkson in his home on
Feb. 3, 2003.
Los Angeles County district attorney's spokeswoman Sandi Gibbons said
prosecutors did not oppose the delay and that the trend for delays in
high-profile cases is to be expected.
"The district attorney is used to having cases like this move like a herd of
turtles," Gibbons said.
New York attorney Bruce Cutler, who recently took over Spector's defense, told
reporters he hoped to restore his client's name to what it was before February
2003.
"This case never should have been brought," Cutler said. "Our aim is not only
to win this case but also to win it in the court of public opinion."
Spector, 64, praised his new attorney.
"I think Bruce Cutler is a genius. There was no crime committed and I'm sure
he'll bring forth evidence that the district attorney has been hiding," he
said.
The district attorney's office "obviously disagrees" with Spector's statement
and believes a crime was committed, Gibbons said.
Cutler is representing Spector along with veteran Los Angeles attorney Roger
Rosen. Cutler is best known in New York for his defense of mob boss John Gotti
and has been portrayed by federal prosecutors in New York as "house counsel"
for the Gambino crime family.
Cutler and Rosen recently took over from Leslie Abramson and Marcia Morrissey,
who resigned after working with Spector for about four months.
Clarkson, 40, was best known as the star of Roger Corman's cult film classic
"Barbarian Queen." She was working as a hostess at the House of Blues on the
Sunset Strip and went home from there with Spector the night she was killed.
Spector, famed for creating rock 'n' roll's "wall of sound" recording technique
in the 1960s, is free on $1 million bail.
